Terms of Service

Welcome to In The Book Club. These Terms of Service (“Terms”) are an agreement between you and Leporati Holdings, LLC (“BookClub,” “we,” “us,” or “our”) governing your use of the In The Book Club mobile app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Who can use BookClub

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms. By using the Service you represent that you meet these requirements.

Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for everything that happens under your account. Please give us accurate information and let us know promptly if you believe your account has been compromised.

BookClub Pro subscriptions

In The Book Club is free to use, with an optional subscription - BookClub Pro - that unlocks additional features and removes ads. The following applies to subscriptions purchased through the Apple App Store:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews at the then-current price unless it is canceled at least 24 hours before the end of the current period.
• Your Apple ID is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID account settings after purchase. Deleting the app does not cancel your subscription.
• Prices are shown in the app before you buy and may vary by region. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

Purchases are handled by Apple and are subject to Apple’s terms; refunds are managed by Apple in accordance with its policies.

Your content

You keep ownership of the reviews, ratings, comments, lists, messages, photos, and other content you create (“Your Content”). By posting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it as needed to operate and improve the Service - for example, showing your review to other members. This license ends when you delete Your Content or your account, except for copies retained as described in our Privacy Policy or shared before deletion.

Community rules and acceptable use

BookClub is a community for readers, and we have zero tolerance for objectionable content or abusive behavior. You agree not to post content or take actions that:

• are unlawful, harassing, threatening, hateful, or that bully or target another person;
• are pornographic, sexually explicit, gratuitously violent, or otherwise objectionable;
• infringe anyone’s intellectual property, privacy, or other rights;
• are spam, fraudulent, deceptive, or promote illegal activity;
• impersonate another person or misrepresent your affiliation; or
• attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service.

You can report content or members, and block anyone you don’t want to interact with, from within the app. We review reports and may remove content and suspend or terminate accounts that violate these Terms - and we aim to act on objectionable-content reports and eject the offending user promptly.

Book information and third-party content

Book details, covers, and related information come in part from third-party sources such as open book catalogs. We do our best to keep this information accurate but do not guarantee it, and we are not responsible for third-party content or services.

Our intellectual property

The Service itself - including its name, design, software, and branding - is owned by us and protected by law. These Terms don’t grant you any right to use our trademarks or the Service except as needed to use it as intended.

Termination

You can stop using the Service and delete your account at any time from Settings in the app. We may suspend or terminate your access if you violate these Terms or if we need to for legal, security, or operational reasons. Sections that by their nature should survive termination - such as content licenses already granted, disclaimers, and limitations of liability - will survive.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, BookClub and Leporati Holdings, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles, except where the law of your place of residence requires otherwise.
